By accessing or using Maxemo (the "Service"), you agree to be bound by these Terms and Conditions ("Terms"), our Privacy Policy, Acceptable Use Policy, and Subscription and Auto-Renewal Terms (collectively, the "Agreements"). If you do not agree, you must not use the Service.
By clicking "I Agree," creating an account, or using the Service, you represent that: (a) you have read and agree to these Terms; (b) you are of legal age to form a binding contract in your jurisdiction (at least 18 in India, or the applicable age of majority); and (c) you have authority to enter into these Terms. If you are under 18 in India (or below the age of contractual capacity in your jurisdiction), you may use Maxemo only with the involvement and consent of your parent or legal guardian, who agrees to these Terms on your behalf and assumes responsibility for your use.
To use the Service you must: (a) be at least 18 years of age, or, if between 16 and 18, have verifiable consent from your parent/guardian; (b) not have been previously suspended or removed; and (c) not be prohibited under applicable law. Maxemo is designed for medical graduates and doctors around the world preparing for postgraduate medical entrance and licensing examinations; our users are overwhelmingly adults.
4.1 Account Creation. You create an account with accurate information, including your name, email address, and date of birth. A profile photograph is optional and may be added after registration. (We do not collect a mobile/phone number.)
4.2 Account Security. You are responsible for safeguarding your credentials and all activity under your account. You agree to: keep your password confidential; not share credentials; notify us at hello@blackpie.co of any unauthorized access; and not create more than one account per person.
4.3 Account Accuracy. Keep your information accurate and current.
4.4 Suspension/Termination. We may suspend or terminate your account, without prior notice, if we reasonably believe you have violated these Terms, engaged in fraud, or pose a security risk — see also Sections 7, 8, and 17.
Maxemo provides medical exam-preparation resources for doctors and medical graduates worldwide, including:
(a) the current-day Daily Free Test (DFT) and, for Plus subscribers, previous days' DFTs (Free-plan users may view only the current day and the past two days — see Section 9);
(b) the ability to create your own sessions/tests;
(c) a Library where you can keep materials, Question Banks, and quizzes/series you create, and add items shared by the Community (subject to the Free-plan limit in Section 7.4);
(d) performance analytics after each Session, with some analytics locked on the Free plan;
(e) certain premium study materials that are locked on the Free plan and unlocked for Plus subscribers, including temporarily during your free trial (see Section 9); and
(f) the Free plan and the paid Plus plan, and a one-time 7-day free trial of Plus, as described in our Subscription and Auto-Renewal Terms.
We may modify, suspend, or discontinue any part of the Service, with reasonable notice where practicable. From time to time we may add free features to enhance the Service at no additional charge; such free features may also be modified or withdrawn, with reasonable notice where practicable.
6.1 License Grant. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal, non-commercial, educational purposes.
6.2 Restrictions. You will not: (a) copy, reproduce, distribute, republish, or transmit Platform Content except as permitted; (b) create derivative works of the Service or Platform Content; (c) reverse engineer the Service; (d) use bots, scrapers, or crawlers to extract data; (e) resell or transfer access to your account; (f) remove proprietary notices; (g) impair the Service or interfere with others' use; (h) circumvent security features; (i) use the Service unlawfully; (j) share, distribute, or commercially exploit Platform Content with third parties; (k) screen-capture or record large portions of Platform Content for redistribution; or (l) use the Service to build a competing product.
6.3 Scope. The license is per-user and per-account and lasts only for your active account (and, for Plus features, your active Subscription).
7.1 Ownership. You retain ownership of your User Content (including sessions you create). We do not claim ownership.
7.2 License to Us. By creating a session or adding material to your Library, you grant us a worldwide, non-exclusive, royalty-free, sublicensable (only as needed for service operation, e.g., to cloud providers) license to host, store, process, and display that User Content to provide the Service to you. This license terminates when your User Content is deleted from our systems per our retention schedule.
7.3 Your Representations. You represent and warrant that: (a) you own or have the rights to any material you add to your Library or upload; (b) it does not infringe any third party's intellectual-property, privacy, or other rights; (c) it is not unlawful, defamatory, obscene, or otherwise objectionable; and (d) it contains no malicious code.
7.4 Community Materials; Free-Plan Limit. You may add materials and Question Banks shared by the Community to your Library and edit your own copy of them. On the Free plan, you may keep up to three Community-sourced materials/Question Banks in your Library at any one time; to add more, you must subscribe to Plus or remove an existing item. Plus subscribers are not subject to this limit. Where you add another user's material, that user's authorship attribution is preserved, and you must not present it as your own original work.
7.5 Prohibited Conduct. In addition to the Acceptable Use Policy, you agree not to: (a) share account credentials; (b) use the Service to distribute unauthorized copies of copyrighted textbooks, Question Banks, or proprietary materials; (c) upload, post, or share leaked, recalled, or "memory-based" live examination content, or otherwise engage in exam malpractice; or (d) violate any applicable law.
7.6 Content Removal. We may remove or disable access to User Content that, in our reasonable judgment, violates these Terms or applicable law. Where we remove your content, we will take reasonable steps to notify you.
If you are a rights holder (or authorized agent) and believe Content on Maxemo infringes your copyright — including materials or Question Banks in a user's Library — submit a notice to our Designated Copyright Agent:

Your notice must include: (a) your signature; (b) identification of the work; (c) identification and location of the infringing material; (d) your contact details; (e) a good-faith-belief statement; and (f) an accuracy statement (under penalty of perjury for DMCA notices). On a valid notice, we will promptly remove or disable the identified material and make reasonable efforts to notify the user who added it.
Repeat-Infringer Policy. Three valid, uncontested infringement notices against the same account result in suspension of that account; a further valid notice results in permanent deletion of the account and a prohibition on creating a new account, with no refund for any unused Subscription period. We may act sooner for particularly egregious infringement.
Counter-Notice. If your content was removed and you believe this was a mistake or that you have the right to use it, you may submit a counter-notice to the Designated Copyright Agent including your signature, identification of the removed material, a good-faith statement, your contact details, and consent to jurisdiction under Section 16. If the complainant does not commence a court action within the period required by applicable law, we may restore the content.
Detailed terms are in our Subscription and Auto-Renewal Terms, incorporated by reference. In summary:
9.1 Free Plan. Registration is free and does not require a payment method. On the Free plan: (a) you may attempt a maximum of two Sessions per day; (b) some analytics are locked; (c) you may view only the current day's and the past two days' DFTs; (d) you may keep up to three Community-sourced materials/Question Banks in your Library (Section 7.4); and (e) certain premium study materials are locked and cannot be opened.
9.2 Plus Plan. A Plus Subscription removes all of the limits described in Section 9.1, including unlocking all locked materials and analytics. Plans and pricing are: 3-month — $149; 6-month — $269; 12-month — $349, billed at the start of each term and renewing automatically at the end of each term unless cancelled.
9.3 Free Trial. New users may access a one-time 7-day free trial of Plus. A payment method is required to start the trial. During the trial, locked materials and locked analytics are unlocked, just as on a paid Plus Subscription. If you do not cancel before the trial ends, your Plus Subscription begins automatically and you will be charged; if you cancel, or the conversion payment fails, locked materials and analytics automatically re-lock and your account reverts to Free-plan limits. Each user may take the free trial only once.
9.4 Payment Processing. Payments are processed by Razorpay; we do not store full payment credentials.
9.5 Taxes. Prices are stated as inclusive or exclusive of applicable taxes (including GST for Indian users) as shown at checkout.
10.1 Company IP. All rights in the Service and Platform Content (including our curated materials, software, design, logos, and trademarks) remain the exclusive property of the Company and its licensors.
10.2 User IP. You retain ownership of your User Content (Section 7).
10.3 Feedback. Feedback you provide may be used by us without obligation to you.
10.4 Copyright Infringement. Follow the procedure in Section 8.
Your data is handled under our Privacy Policy, which is a separate document. By using the Service, you acknowledge that you have read it.
This includes our use of third-party product analytics and session-recording technologies on signed-in pages, described in Section 13 and in Sections 2.2 and 9 of the Privacy Policy. You can opt out of these at any time as described in Section 8 of the Privacy Policy, without affecting your access to the Service.
Please read carefully. (a) Not medical advice — Maxemo is an educational platform; its content, including study materials and practice questions, is for educational and exam-preparation purposes only and does not constitute medical advice, diagnosis, or treatment. (b) No doctor-patient relationship. (c) No substitute for medical education. (d) Clinical decision-making — never rely on Maxemo as the sole basis for patient care or prescribing; verify with authoritative sources. (e) Drug/dosage information is for academic study only — verify against current guidelines. (f) Content accuracy — we do not guarantee accuracy, completeness, or timeliness of any Content, including materials added from the Community. (g) No guarantee of results — we do not guarantee any exam score, rank, or admission.
The Service relies on third parties governed by their own terms/policies, including Razorpay (payments), Amazon Web Services (cloud storage, EU region), Google (Google Sign-In), Cloudflare (DNS/security), PostHog (product analytics), and Zoho PageSense (heatmaps and session recording on signed-in pages). We are not responsible for third-party services and encourage you to review their policies.
Analytics and session recording. When you are signed in, PostHog receives account details including your name, username, email address, and account role together with the pages and features you use, and Zoho PageSense collects heatmap and session-recording data on those same pages. We use both only to understand and improve the Service, never for advertising. What they receive, how long it is kept, the safeguards that apply to recordings, and how to opt out are set out in our Privacy Policy (Sections 2.2, 4, 7, 8, 9, and 11).
14.1 Disclaimer of Warranties. To the maximum extent permitted by law, the Service is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that results will be accurate or reliable.
14.2 Limitation of Liability. To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill. Our total aggregate liability for all claims shall not exceed the greater of (i) the amount you paid us in the 12 months preceding the claim, or (ii) 10000 INR. These limits do not apply to liability for gross negligence or willful misconduct, death or personal injury caused by our negligence, or any liability that cannot be limited under applicable law (including the Consumer Protection Act, 2019 (India) and other mandatory local consumer-protection law). Nothing in these Terms limits your mandatory statutory consumer rights.
To the extent permitted by law, you agree to indemnify and hold harmless the Company and its directors, officers, employees, and agents from claims, liabilities, damages, losses, and costs (including reasonable legal fees) arising from: (a) your breach of these Terms; (b) your User Content, including infringement of third-party rights; (c) your violation of law; or (d) a dispute between you and a third party relating to your use of the Service.
16.1 Governing Law. These Terms are governed by the laws of India, without regard to conflict-of-law rules.
16.2 Dispute Resolution. The parties will first attempt good-faith negotiation, then follow the two-step Grievance Redressal process in Section 20. For Indian users, unresolved disputes go to mediation (Mediation Act, 2023, where applicable) and then binding arbitration (Arbitration and Conciliation Act, 1996) seated in Ernakulam in English, by a sole arbitrator. For all users, the courts of Ernakulam, India, have exclusive jurisdiction over disputes not resolved by arbitration, subject to Section 16.3.
16.3 Indian Consumers. Nothing restricts your right to approach a Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019. Users in the UAE or elsewhere retain any mandatory local consumer-protection rights that cannot be waived by contract under their own local law.
17.1 By You. Cancel anytime via account settings or by emailing hello@blackpie.co. Your license ends on termination.
17.2 By Us. We may suspend or terminate your account for breach, legal requirement, or suspected compromise/fraud. We may also discontinue the Service — for example, in response to exceptional or unforeseen circumstances, events beyond our reasonable control, or to comply with a legal requirement. If we discontinue the Service, we will give you reasonable prior notice (no less than 30 days where practicable) so that you can export your Library content, and if we discontinue before the end of a fixed term you have prepaid, we will refund the portion of the fees you have paid for the Service not yet received.
17.3 Effect. On termination: your license is revoked; your User Content is handled per the Privacy Policy and retention schedule; refund provisions in our Subscription and Auto-Renewal Terms apply; and Sections 7.2, 8, 10, 12, 14, 15, 16, and this 17.3 survive.
We may modify these Terms. For material changes we will update the "Last Updated" date and notify you by email to your registered email address and by a pop-up notification inside the app at least 30 days before they take effect; for changes affecting your rights we may require re-acceptance. Continued use after the effective date constitutes acceptance.
Entire Agreement (these Terms + the other Agreements); Severability; Waiver; Assignment (we may assign; you may not without our consent); Force Majeure; Electronic Communications (you consent to receive notices electronically, including by email and in-app pop-up notification); Language (English governs).
